TD: Good post, that's what I like to see in an argument, well reasoned and backed with facts not sound bites or urban legends. As to whether Lincoln acted extra-constitutionally or not, he probably did. But he was responding to an action that was extra-constitutional too. The authority to suspend habeas corpus during an emergency when congress was not in session was no more ambigious than the right of the states to unilatterally secede from the Union.
