This decision was made by General Montgomery Meigs, the Quartermaster General. His intention was to make the estate uninhabitable should the Lee family try to return after the war.

After the war, the Lee family was able to prevail in their court case against the government for the illegal confiscation of the estate. The decision was made by George Washington Custis Lee to accept a cash settlement rather than having thousands of existing soldiers' graves removed.
