Albert- That confused me as well, so I checked into it. According to this source, Pender was indeed a lieutenant colonel in the 1st North Carolina- at least for a short time in 1861. I believe that he was promoted to colonel of the 3rd North Carolina with the effective date of 27 May 1861.
